This document contains the various terms and conditions (the T&Cs) under which  Aavik Insurance Brokers Pvt Ltd provides the services described below (the Services) to you, the customer/client. ‍ Please note that the below T&Cs are binding and supersede any prior, or other, correspondence pertaining to the subject matter set out herein, and may be varied at  Aavik Insurance Brokers Pvt Ltd 's behest with prior notice provided to you.

 Aavik Insurance Brokers Pvt Ltd is an healthcare, wellness and insurance management platform and shall, in addition to providing you information about various policies and products, act as an employee benefits provider and insurance agent and may, inter alia, perform the following Services for you: Understand your requirements in respect of the Health Benefits and Insurance (the Product) that you may want to purchase, and obtain information regarding such Product; Use the information so received in order to obtain a Product quote from the market; Act, on your behalf, and in furtherance of instructions received from you in respect of the purchase of the Product; We Provide various tech-based services which entail the use of its website, dashboard and/or mobile application(s) for use by employers and employees alike to purchase various related products and policies and also obtain various health benefits and allied services.

Please note that it is your responsibility to ascertain the nature of the Product that you would like to purchase, and that  Aavik Insurance Brokers Pvt Ltd shall assume neither responsibility nor liability in respect of any purchases made by you. 

Further, it is your responsibility to disclose to us, in a time bound manner, any and all information which is material to your requirements, and  Aavik Insurance Brokers Pvt Ltd will not be responsible for any deficiency in information provided.

 Aavik Insurance Brokers Pvt Ltd will not be responsible for any loss or liability arising out of disclosure of personal details relating to credit card or bank account to any third party by you. You shall take all necessary precautions to prevent unauthorized and illegal use of this facility and therefore shall not disclose the details of its credit card to any other person to prevent its unauthorized use.  Aavik Insurance Brokers Pvt Ltd shall not be liable for any misuse of  any banking information pertaining to you and you shall be responsible for maintaining the secrecy of his banking information and shall not divulge the same to any person whatsoever.

You expressly understand and unconditionally agree that you will not hold  Aavik Insurance Brokers Pvt Ltd liable for any direct, indirect, punitive, incidental, special or consequential damages whatsoever, including but not limited to damages or losses resulting from

1. The use or performance or inability to use or non-performance of the facilities.
2. The provision of failure to provide the facilities.
3. Such transactions that are carried out on your  instructions in good faith.
4. Any loss or damage incurred or suffered by you due to any defect, error, failure or interruption in the provision of the facilities.
5. Any other matter related to the facilities.

Further, Aavik Insurance Brokers Pvt Ltd expressly disclaims any responsibility and liability for any deficiency in services provided by third parties whether or not such third parties are affiliated to  Aavik Insurance Brokers Pvt Ltd.

 Aavik Insurance Brokers Pvt Ltd shall treat any information pertaining to you and in its possession with extreme confidentiality. Such information shall only be disclosed in furtherance of its engagement with you, and for such purposes as may be necessary in the course of its legitimate business activities. Any sensitive personal information shall be handled as per the provisions of the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information Rules, 2011). It is made clear that  Aavik Insurance Brokers Pvt Ltd does not undertake any liability, responsibility or warrant for the details, accuracy, completeness or correct sequence of any content, services or the reliability of any service, statement or other information displayed or provided through any third-party websites.

Either party may terminate this agreement by providing prior written notice of 90 (ninety) days, or by mutual agreement. Notwithstanding such termination,  Aavik Insurance Brokers Pvt Ltd shall lend assistance in respect of any Product and policy whose term is ongoing, until the expiry of such term unless expressly forbidden by you at the time of such termination.

You hereby grant  Aavik Insurance Brokers Pvt Ltd the right to use, analyse and assess information held about you in order to give you information about various products and services that  Aavik Insurance Brokers Pvt Ltd may believe to be of interest to you. Such right is revocable at your discretion and may be revoked by written notice to such officer as  Aavik Insurance Brokers Pvt Ltd may notify. 

In the event of any dispute in respect of this Agreement, your Product and any policy governing the Product, the Courts at Mumbai shall exercise sole and exclusive jurisdiction and the terms of such Agreement, your Product and any policy governing the Product shall be construed and interpreted as per the laws of the Republic of India.
